- A foreign professional we plan to hire is currently working in Japan for another company and holds a Highly Skilled Professional (i)(b) visa. After joining our company, they are expected to continue in the same role authorized under their current status. In this case, can they start working for us without any additional immigration procedures?
- No. It is not possible to begin employment with your company under the current status of residence. You must file an application for Change of Status of Residence, designating your company as the contracting organization, and obtain a new Highly Skilled Professional (i)(b) authorization. Details are as follows:
First, the Highly Skilled Professional (i)(b) visa allows employment only at institutions specifically designated by the Minister of Justice. When the Immigration Services Agency approves this status, a “Designation Letter” is issued alongside the residence status decision. The company listed on this letter is considered the designated organization. The designation letter is typically stapled into the applicant’s passport.
In the present case, the Designation Letter lists another company. Therefore, in order for the individual to begin work with your company, you must submit a Change of Status of Residence application at the Regional Immigration Bureau with jurisdiction over the employee’s place of residence, listing your company as the new contracting organization. While the visa category itself remains “Highly Skilled Professional (i)(b),” the procedure required is formally a Change of Status of Residence.
It should also be noted that when changing from one Highly Skilled Professional (i) status to another, supporting documentation proving the applicant’s point calculation under the Highly Skilled Professional points system must be resubmitted. Upon approval, a new Residence Card and updated Designation Letter will be issued.
